The Akiak Advantage

The Akiak Building People can receive sole-source awards of any size and cannot be challenged or protested by another participant or any other party due to their status of a tribal-owned business. 

13 CFR 124.571(a)


 Tribal 8(a) Sole source awards can be of any size for it is exempt from the $4M ceiling for civil agencies. Civilian agencies can sole source an award for up to $25M, while Defense can sole source an award for up to $100M. There is no requirement that a procurement must compete whenever possible before it can be accepted on a sole-source basis for a Tribally owned concern.

For acquisitions above the simplified acquisition threshold, Contracting Officers shall first consider the 8(a) program before considering small business set-asides.

 Agency contracting goals instruct certain federal agencies in how much of their contracting dollars should be awarded to small businesses. Agencies submit their proposed goals to the SBA annually.
